FINDINGS and DISCUSSION
Findings of Fact: Complainant belongs to the LIDL-Group, a famous global discount supermarket chain based in Germany. The LIDL-Group operates more than 10,000 stores with over 285,000 employees. Currently Lidl stores can be found in 29 countries. In Germany LIDL operates around 3,200 stores. It owns numerous national and international trademarks “LIDL.†|
Even though the Respondent has defaulted, URS Procedure 1.2.6, requires Complainant to make a prima facie case, proven by clear and convincing evidence, for each of the following three elements to obtain an order that a domain name should be suspended.
[URS 1.2.6.1] The registered domain name(s) is/are identical or confusingly similar
to a word mark: Determined: Finding for Complainant Examiner finds that Complainant holds a valid national or regional trademark registration and that is in current use. Examiner finds that the disputed domain name <lidl-de.online> is confusingly similar to Complainant's trademark “LIDL.†[URS 1.2.6.2] Registrant has no legitimate right or interest to the domain name. Determined: Finding for Complainant Examiner notes that i) the disputed domain name is not used for bona fide offering goods or services as it does not resolve into an active website; ii) Complainant has not authorized Respondent to use its trademark “LIDL†or register the domain name and is not affiliated with Respondent; and iii) Respondent is not commonly known by the disputed domain name. Therefore, Examiner determines that Respondent has no legitimate right or interest to the disputed domain name.
[URS 1.2.6.3] The domain name(s) was/were registered and is being used in bad faith.
Determined: Finding for Complainant Examiner infers that Respondent registered the disputed domain name with actual knowledge of Complainant’s rights in its mark LIDL due to the notoriety of Complainant’s mark. Examiner notes that Respondent has not made active use of the domain name since its registration. Taking into account the notoriety of Complainant’s mark, Examiner determines that Respondent’s passive holding of the disputed domain name constitutes bad faith registration and use. FINDING OF ABUSE or MATERIAL FALSEHOOD The Examiner may find that the Complaint was brought in an abuse of this proceeding or that it contained material falsehoods. The Examiner finds as follows:

After reviewing the parties submissions, the Examiner determines that the Complainant
has demonstrated all three elements of the URS by a standard of clear and convincing
evidence; the Examiner hereby Orders the following domain name(s) be SUSPENDED for
the duration of the registration:
