FINDINGS and DISCUSSION
Findings of Fact: The Complainant, Factory X Pty Ltd, represented by Messrs. K&L Gates of Melbourne, Australia, is the exclusive licensee of the registered GORMAN trade marks (the "Mark") (including Australian trade mark registration number 1484739) from Gorman Brands Pty Ltd. The disputed domain name is <gormanau.shop> ("Domain Name"). The Respondent has registered the Domain Name without the permission of the Complainant or Gorman. The Domain Name is identical with or confusingly similar to the Mark, as it incorporates the Mark in full, with the addition of 'au', which is an abbreviation for Australia, and the TLD '.shop'. The Complainant has shown by clear and convincing evidence that the Domain Name resolves to a website which is virtually indistinguishable from the Complainant's official website, using Gorman photographs to promote the distinctive Gorman fashion getup and branding (including its hot pink colouring), in competition with the Complainant. The Domain Name misleadingly and in bad faith suggests that it provides access to a shop for genuine Gorman-branded goods when it does not. |
Even though the Respondent has defaulted, URS Procedure 1.2.6, requires Complainant to make a prima facie case, proven by clear and convincing evidence, for each of the following three elements to obtain an order that a domain name should be suspended.
[URS 1.2.6.1] The registered domain name(s) is/are identical or confusingly similar
to a word mark: Determined: Finding for Complainant The Domain Name is identical or confusingly similar to a word mark for which the Complainant holds a valid national or regional registration and that is in current use. [URS 1.2.6.2] Registrant has no legitimate right or interest to the domain name. Determined: Finding for Complainant The Complainant alleges that the Registrant has no legitimate right or interest to the domain name. The Registrant has failed to submit a response timely, or at all, and has not refuted the Complainant's allegations which are, accordingly, accepted by the Examiner as true.
[URS 1.2.6.3] The domain name(s) was/were registered and is being used in bad faith.
Determined: Finding for Complainant By using the Domain Name, the Registrant has intentionally attempted to attract for commercial gain, Internet users to Registrant's web site or other on-line location, by creating a likelihood of confusion with the Complainant's Mark as to the source, sponsorship, affiliation, or endorsement of Registrant's web site or location or of a product or service on that web site or location. |
